myConnect Terms and Conditions

These Terms and Conditions (the “Terms”) govern your use of myConnect at https://myconnect.rocks and its related listings, accounts, forms, calculators, messaging tools, and financing features (the “Platform”). The Platform is operated by VC Property Group LLC (“myConnect,” “we,” or “us”). By using the Platform, creating an account, submitting a form, or posting a listing, you agree to these Terms. If you use the Platform for a brokerage or other organization, you represent that you have authority to bind it, and “you” includes that organization. If you do not agree, do not use the Platform.

Our Privacy Policy explains how we handle personal information. A separate agreement or disclosure for a specific brokerage, valuation, or financing engagement controls that engagement if it conflicts with these general Platform Terms.

1. What myConnect does

myConnect provides commercial real estate listing and search tools, broker profiles, lead and contact management, email campaign features, property and investment calculations, and ways to request information or financing. Features may change and may not be available in every location. Access to a listing, a broker profile, or a financing feature does not itself create an agency, brokerage, fiduciary, lender, borrower, or client relationship with myConnect or any listed professional. Any such relationship requires the applicable separate agreement and disclosures.

myConnect and its operator may separately provide real estate brokerage and commercial mortgage brokerage services where authorized. When we do, the nature of our role, any compensation, and the parties we represent will be addressed in the applicable engagement documents. We may receive compensation in connection with transactions or financing where permitted by law and disclosed as required. Users are not required to obtain financing through myConnect to inquire about or pursue a property unless a separate lawful transaction document expressly provides otherwise.

2. Accounts and professional access

You must be at least 18 years old and provide accurate, current information. Keep your credentials secure; you are responsible for activity under your account and must notify us promptly of unauthorized use. You may not share an account or impersonate a person or brokerage.

Agents and brokers who publish listings must have the authority to do so, maintain all licenses and supervision required for their activity and property locations, comply with their brokerage’s policies, and promptly update their profile and license information. A “verified” badge or similar designation means only that we performed the verification steps we chose at that time; it is not a guarantee of current licensure, good standing, identity, authority, performance, or the accuracy of a listing. We may request supporting information, reject an application, or suspend professional access.

3. Listings and submitted information

The person or organization submitting a listing is responsible for its content, authorization, accuracy, legal compliance, and timely updates. This includes price, availability, property characteristics, photographs, documents, unit counts, rent rolls, actual and projected income, expenses, zoning, permitted use, occupancy, tax information, financing assumptions, and any claims about returns. Clearly distinguish actual results from estimates, projections, and stabilized scenarios. Correct or remove information when it becomes materially inaccurate or the listing is no longer available. Do not post a property without the owner’s or authorized representative’s permission, or post confidential materials without authority.

Fair housing and lawful advertising

Every professional who submits, edits, distributes, or responds to a listing must comply with the federal Fair Housing Act and applicable state and local fair housing and anti-discrimination laws. For a dwelling or housing-related service, do not state or imply a preference, limitation, or exclusion based on race, color, religion, national origin, sex, familial status, disability, or any additional category protected where the property or recipient is located. This applies to descriptions, photographs, tags, lead screening, responses, email campaigns, audience selection, and the use of Platform tools. Do not withhold listings, vary terms, steer prospects, or use targeting criteria or proxies to exclude protected groups. For commercial properties, follow any anti-discrimination laws applicable to the transaction. You are responsible for reviewing your content and practices before publication and correcting violations promptly. We may remove content or suspend access when we reasonably believe it violates these rules, but our review or publication is not legal approval or a substitute for your brokerage’s supervision.

Listings and advertisements must also comply with applicable real estate licensing, advertising, accessibility, consumer protection, privacy, and other laws. State laws and your brokerage may impose additional requirements, including identification, disclosures, recordkeeping, and offer handling. A listing on myConnect is not an MLS entry and does not satisfy any separate MLS, client, brokerage, or legal obligation. “Off market” describes how a listing is presented on the Platform and does not guarantee exclusivity, confidentiality, or that it is unavailable elsewhere.

You retain ownership of content you have the right to submit. You grant myConnect a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, distribute, and promote that content in connection with operating and marketing the Platform and the applicable listing, including previews and communications initiated through the Platform. This license lasts while the content is on the Platform and for reasonable backups, records, previously distributed communications, and legal compliance after removal. You represent that you have the rights and permissions needed to grant this license. You may request removal of your listing, subject to records we must or reasonably need to retain. We may edit formatting, label, decline, suspend, or remove content, but are not obligated to verify it.

4. Property information and calculations

Listing content is provided by brokers, owners, users, and other third parties. We do not warrant that it is complete, current, independently verified, or suitable for a particular transaction. Buyers, tenants, lenders, and other users must conduct their own due diligence and consult appropriate licensed professionals. A property may be withdrawn, repriced, sold, leased, or otherwise unavailable without notice. A displayed listing is not an offer or a guarantee that a transaction can be completed.

The Platform may calculate NOI, NCF, cap rate, ROI, DSCR, debt service, estimated payments, cash to close, value, or other figures using submitted or assumed inputs and general methods. Outputs may reflect projected or stabilized performance rather than current operations. Small changes in inputs, loan terms, tax treatment, insurance, capital expenditures, vacancies, or market conditions can materially change results. Calculations and loan matches are illustrative tools, not an appraisal, formal valuation, investment recommendation, commitment to lend, loan approval, or promise of return. Unless a separate written engagement says otherwise, myConnect has not audited underlying records or inspected the property. Review the inputs and obtain independent professional advice before acting.

5. Leads, contacts, and communications

If you inquire about a property, request a showing, submit an RSVP, or use a contact form, information you provide may be sent to the listing professional or other party identified in that flow so they can respond. The recipient may act independently and is responsible for its own communications and privacy practices. Do not submit another person’s information without authority. Submitting a form does not make you a client of the recipient or guarantee a response.

Professional users who upload contacts, manage leads, or send email campaigns are responsible for obtaining and documenting any required permission; maintaining accurate lists and suppression records; honoring unsubscribe and do-not-contact requests; providing legally required sender identity, physical address, and opt-out mechanisms; and complying with applicable email, telemarketing, privacy, and real estate advertising laws. You may use these tools only for lawful communications related to your business. Do not harvest Platform data, buy or upload unlawful lists, send deceptive or unsolicited bulk messages, or bypass rate limits or suppression controls. myConnect may impose sending limits or suspend campaigns to protect recipients and the Platform. Use of a myConnect email tool does not transfer responsibility for the contents or lawful delivery of your campaign to us.

Any consent to calls, texts, or marketing must be obtained through the applicable form or another lawful process. Agreement to these Terms alone is not consent to receive marketing texts or automated calls. Transactional or service communications may still be sent as permitted by law. The relevant form and the Privacy Policy should explain who may contact you and how to opt out.

6. Financing inquiries and mortgage brokerage

Submitting a financing request, using a loan matcher, or seeing an estimated rate or payment is an inquiry, not a completed loan application, preapproval, rate lock, commitment, or offer of credit. Availability, eligibility, rates, points, fees, loan amounts, required equity, and closing timelines depend on the lender, property, borrower, credit, documentation, market conditions, and applicable law. A lender or authorized provider makes credit decisions; we do not guarantee approval or funding.

To evaluate or arrange a financing request, myConnect or the separately identified mortgage brokerage may contact you, request additional documentation, and, as described in the financing form and Privacy Policy, share relevant information with prospective lenders, capital sources, underwriters, service providers, or transaction professionals. Any credit report authorization, electronic signature, disclosure, fee agreement, or lender application will be presented separately when required; these Terms do not by themselves authorize a credit pull. Do not place Social Security numbers, bank credentials, or other highly sensitive information in general contact or listing forms. Use only an approved secure application or upload process when instructed.

Any broker fee, referral fee, compensation, exclusivity, or other financing obligation must be set out in a separate applicable agreement or disclosure. Products involving consumer or owner-occupied property may require different terms, notices, licenses, or processes. The Platform’s general descriptions do not replace those requirements.

7. Fees and paid features

Features identified as free are free at the time offered. If we introduce a paid plan or feature, we will show its price, billing frequency, included features, renewal and cancellation terms, and any applicable taxes before purchase. No paid subscription is created solely by accepting these Terms. Fees for brokerage, financing, valuation, or other professional services, if any, are governed by the relevant separate agreement. We may change future pricing with notice appropriate to the plan and applicable law; a price change will not retroactively alter an already paid period.

8. Acceptable use and Platform rights

Do not use the Platform to commit fraud, infringe rights, discriminate, misrepresent a property or license, transmit malware, interfere with security, or use another user’s account or contact information without authorization. You may view and share individual listing links for legitimate property evaluation and transaction purposes.

Except with our prior written permission or to the extent a restriction is prohibited by applicable law, you may not: (a) copy, download in bulk, scrape, crawl, harvest, or systematically extract listings, leads, contact details, calculated outputs, or other Platform data; (b) access nonpublic code, APIs, databases, or systems without authorization, or circumvent access controls, rate limits, or technical safeguards; (c) reverse engineer, decompile, disassemble, or attempt to derive source code, underlying models, algorithms, calculation logic, or nonpublic architecture from the Platform; (d) reproduce, adapt, or build a competing product using our protected software, content, designs, data compilations, or confidential information; or (e) permit a third party to do any of the foregoing through your account. This clause does not claim ownership of general ideas, independently developed methods, facts, or content you own, and does not restrict rights that law makes nonwaivable.

We own the Platform’s software, design, branding, and original content, subject to users’ rights in their own submissions. We may update or discontinue features, moderate content, and suspend or terminate access for violations, legal risk, security concerns, or misuse. Where practical, we will give notice and a way to retrieve your own content, but availability is not guaranteed. You may stop using the Platform and request account closure through the contact method below, subject to legally required or legitimate record retention.

9. Other parties and transactions

The Platform may link to third-party websites or use third-party maps, sign-in, payment, email, or other services, which may have their own terms. We do not control their content or availability. Brokers, buyers, sellers, landlords, tenants, and lenders remain responsible for their own representations, decisions, agreements, and legal obligations. A purchase, lease, brokerage, or loan transaction is governed by its own signed documents. Except to the extent myConnect or its operator is expressly a party to a separate agreement, these Terms do not make us a party to a transaction between users.

10. Disclaimers and responsibility

To the extent permitted by law, the Platform is provided “as is” and “as available,” without a guarantee of uninterrupted access, error-free calculations, listing accuracy, lead volume, deal completion, financing, or investment results. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

To the extent permitted by law, myConnect and its operator are not liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the Platform. Our aggregate liability for a Platform-related claim will not exceed the greater of $100 or the amount you paid us for Platform access in the 12 months before the event giving rise to the claim. This limit does not apply where prohibited by law, or to liability that cannot lawfully be limited, and does not alter obligations in a separate signed professional services agreement.

If your unlawful conduct, submitted content, or breach of these Terms causes a third-party claim against myConnect or its operator, you agree to defend and reimburse us for reasonable losses and costs, including reasonable attorneys’ fees, to the extent permitted by law. We will give reasonable notice and allow you to participate in the defense. This provision does not require you to cover our own unlawful conduct or gross negligence.

11. Changes, law, and contact

We may revise these Terms by posting an updated version with a new effective date. For material changes affecting existing accounts, we will provide reasonable notice through the Platform or the contact information on file. Changes apply prospectively; continued use after they take effect constitutes acceptance. If you do not agree, stop using the Platform and close your account.

Connecticut law governs these Terms, without regard to conflict-of-law principles, except where another law must apply. Courts located in Connecticut will have jurisdiction over disputes arising from these Terms, subject to any mandatory consumer protection law. Before filing a claim, you may contact us to try to resolve the issue informally. If a provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any applicable separate agreement comprise the relevant agreement for their respective subjects.
